Terms of Service

Last updated 27 August 2026 · Version 2026-08-27

These Terms apply between the business using AI Receptionist (you or the Customer) and Simon Bird (ABN 79 390 603 143), an Australian sole trader operating MarketReady.ai (Market Ready, we, us or our).

By creating or using an account, accepting an Order, or allowing AI Receptionist to answer calls, you agree to these Terms and confirm that you are authorised to act for the Customer.

The service

AI Receptionist can answer eligible forwarded inbound calls, identify itself as AI, take a callback message, create a transcript and summary, store the call record in the signed-in account, and send a concise summary to verified email or, separately enabled, SMS recipients.

Unless we expressly agree otherwise, it does not transfer calls, make bookings, quote prices, accept payments or legal notices, guarantee callbacks, access private business systems, authorise work, or give legal, financial, property, medical or other professional advice.

The service is not an emergency line and must not replace Triple Zero (000), emergency services or another time-critical contact method.

Your responsibilities

You are responsible for:

  • providing accurate business, account and notification details;
  • protecting account access and authorised recipients;
  • correctly configuring and testing call forwarding and fallback behaviour;
  • having authority to provide business, Caller and other information to the service;
  • ensuring your use, caller notice, recording, transcription and handling of call information comply with applicable laws; and
  • reviewing important names, contact details, deadlines and instructions directly with the Caller.

You must not remove or contradict the service's AI, recording or transcription notice.

AI, calls and notifications

Transcripts, summaries and extracted details may be incomplete, delayed or inaccurate because of AI limitations, speech, background noise, connectivity or provider failures. They are message-taking aids, not verified records or professional advice.

Call answering, email and SMS delivery are not guaranteed. You must keep another suitable contact method available and must not rely on AI Receptionist where a missed or delayed message could cause serious harm.

SMS summaries are optional and require the separate activation or consent shown in the product. Carrier charges may apply, and a recipient can withdraw from SMS summaries.

Acceptable use

You must not use the service unlawfully, deceptively or fraudulently; harass or impersonate anyone; collect information without authority; interfere with security; upload malicious material; attempt unauthorised access; use it for unsolicited telemarketing; or use it to make decisions affecting legal rights, housing, employment, credit, insurance, healthcare or access to essential services.

We may restrict or suspend the service where reasonably needed to address unlawful use, non-payment, security risk, provider requirements or a serious breach of these Terms.

Plans and payment

Your accepted Order states the price, billing cycle, included usage, overage, trial, renewal and cancellation terms that apply. Paid terms apply only when you enter a paid Order.

If recurring billing is selected, you authorise our payment provider to charge the nominated payment method when amounts are due. You must keep billing information current and contact us promptly about a disputed charge.

If a recurring payment fails, AI call answering will normally remain active for a 7-day payment-recovery period. If payment is not restored, AI answering will pause and inbound calls may receive a basic fallback message until you reactivate or remove call forwarding.

Data, providers and availability

You retain your rights in information you provide through the service. You give us and our providers permission to host, transmit and process that information only as reasonably needed to provide, secure and support the service or comply with law.

We retain our rights in the service, software, designs, documentation and related technology. Your right to use the service is limited to your business use while your account is active and compliant with these Terms.

The service depends on telecommunications, voice AI, language model, hosting, database, email, SMS and payment providers. Outages, limits and changes outside our reasonable control can affect availability. Where required by our provider terms, you authorise those providers, including ElevenLabs, to process information needed to supply their part of the service.

Ending the service

Either party may end the service as allowed by the applicable Order. When the service ends, AI call answering and notifications may stop. You should export anything you are legally required to keep before the applicable deletion date.

A telephone number supplied for use with AI Receptionist remains controlled by Market Ready or its provider unless we agree otherwise in writing. We normally reserve an assigned number for 14 days after AI answering pauses, then release it to avoid another monthly provider charge. For a failed renewal, this is normally 21 days after the first failed payment. You must remove call forwarding before release if you do not reactivate, and we cannot guarantee that the same number can later be recovered.

Legal terms

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, lost profit, lost opportunity or loss of goodwill. Subject to non-excludable rights, our total liability arising from the service is limited to the greater of the fees paid or payable for the service in the previous 12 months and $1,000.

These Terms are governed by the laws of New South Wales, Australia. We may update them to reflect changes to the service, providers or law and will give reasonable notice of material changes where practicable.

Privacy Policy

Last updated 27 August 2026 · Version 2026-08-27

This Privacy Policy explains how Market Ready handles personal information through AI Receptionist, its website, accounts and support. We aim to follow the Australian Privacy Principles and comply with the Privacy Act 1988 (Cth) where it applies to us.

Information we collect

Depending on how the service is used, we may collect:

  • account, business, login, contact and configuration details;
  • business website details, an uploaded profile document and the business brief reviewed by an account user;
  • telephone numbers, forwarding settings and verified notification destinations;
  • caller details, call audio, transcripts, summaries, timestamps and delivery records;
  • subscription, usage, invoice and payment-status data;
  • support messages, feedback and complaints; and
  • device, browser, IP address, session, diagnostic and security information.

Payment-card details are handled by our payment provider. We do not ordinarily receive or store complete card numbers or card security codes.

How we use information

We use personal information to:

  • create, configure and secure accounts;
  • answer calls, create call records and deliver message summaries;
  • provide support and process subscriptions and billing;
  • diagnose faults, prevent fraud or misuse and improve reliability using minimised or de-identified information where practicable; and
  • comply with law and respond to lawful requests.

Calls can contain personal or sensitive information. The service is intended for concise callback messages, so Callers should share only what is reasonably needed.

Calls and AI

A handled call begins with notice that the Caller is speaking with an AI receptionist and that the call may be recorded and transcribed. The service converts speech to text and uses AI to create a summary and structured record.

AI can make mistakes. Customers should verify important information directly with the Caller. We do not use identifiable call recordings, transcripts or summaries to train a general-purpose Market Ready model.

Sharing and overseas processing

We share information only as reasonably needed to operate, secure and support the service, complete a transaction, comply with law, or carry out a properly managed business transfer.

Depending on the feature used, providers may include Twilio, ElevenLabs, OpenAI, Supabase, Vercel, Resend and Stripe. Information may therefore be processed outside Australia, including in the United States and other countries where those providers or their subprocessors operate.

We do not sell or rent personal information.

Retention and security

We keep personal information only for as long as reasonably needed to provide and secure the service, support an account, resolve disputes and meet legal obligations. Call recordings are normally deleted 30 days after the call. After a paid subscription ends or payment recovery expires, caller records are normally deleted or de-identified after 90 days, and the remaining account and settings after 180 days.

Billing, invoice, tax, security, support, provider and backup records may follow different retention cycles where reasonably required for accounting, fraud prevention, dispute resolution, system recovery or legal compliance.

When information is no longer reasonably required, we take reasonable steps to delete or de-identify it unless it must be retained by law or for a genuine dispute, security incident or investigation.

We use reasonable safeguards such as authenticated access, managed infrastructure, access controls, data minimisation and encryption in transit where supported. No online service is completely secure.

Access, correction and deletion

You may ask to access or correct personal information we hold about you, or request deletion where applicable, by emailing us. We may need to verify your identity and coordinate with the subscribing business before acting.

If you make a privacy complaint, please give us enough information to investigate without sending unnecessary sensitive information. If you are not satisfied with our response, you may be able to contact the Office of the Australian Information Commissioner at oaic.gov.au.

Cookies, marketing and children

We may use essential browser storage or cookies for sign-in, security, preferences and basic operation. If we later introduce optional analytics or advertising technology, we will update this policy and provide any required controls.

Operational account and call messages are not marketing. Any electronic marketing will include an unsubscribe method. AI Receptionist is a business service and is not directed to children.

Changes

We may update this policy when the service, providers or law changes. We will notify Customers of material changes through the service, by email or by another reasonable method where practicable.
